"Participating in an ACO does present new liability issues for
providers. One example is that because ACOs are emphasizing cost
savings, they may be more likely to be suspected of placing financial
considerations above patient safety. The fact that ACOs also have a goal
to improve quality and typically have more physician leadership may alleviate some of these concerns, but ACOs should still be cautious about offering physicians incentives to reduce care costs as this could be seen as a reward for limiting care."
