I believe they see it for what it is -- a transparent attempt by the plaintiffs to do through litigation what could not be achieved through Congress, bringing down the Affordable Care Act. Although the plaintiffs were able to find a sympathetic hearing in two judges in the DC Circuit, their challenge is ultimately going to fail because if one examines the text of the entire law, as courts are bound to do, it is clear that Congress intended all Exchanges, state- operated or federally facilitated, to be able to issue premium tax credits.” Timothy S. "At the close of the Affordable Care Act’s first open enrollment period, an estimated 9.5 million fewer US adults were uninsured, according to a July Commonwealth Fund survey. The national uninsured rate among working age adults dropped from 20% in July-September 2013 to 15% in April-June 2014."
